1. Introduction
Welcome to CivicServiceNexus ("we," "our," or "us"). These Terms & Conditions ("Terms") apply to your use of our yacht charter offerings and our internet presence available at civicservicenexus.site (the "Service") managed by CivicServiceNexus.
By securing a charter or utilizing our Service, you consent to these Terms. If you do not accept any part of these terms, you should refrain from using the Service.
2. Service Overview
CivicServiceNexus offers high-end yacht charter services that include, but are not limited to:
- Day-long yacht rentals
- Sunset cruises
- Company getaways
- Exclusive festivities
- Multiday charters
Our services are available depending on vessel access and weather conditions. We maintain the right to alter or cease services whenever we deem necessary.
3. Booking and Reservations
3.1 Booking Process
When securing a charter, you are required to:
- Have a minimum age of 18 years
- Supply detailed and valid information
- Remit the relevant deposit as indicated in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Only the acknowledgment of your payment and our official confirmation solidify your booking. We reserve the right to decline service to any individual at our discretion.
3.3 Availability
All charters are subject to boat availability and favorable weather conditions. We will endeavor to honor your preferred timetable whenever possible.
4. Payment Terms
4.1 Pricing
All quoted prices are in € and include taxes as applicable unless stated differently. Prices may be adjusted without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the entire charter cost payable at the time of booking
- Remaining Balance: Expected 48 hours prior to the charter's take-off
- Incidental fees (if present): Due upon completion of the charter
4.3 Payment Methods
We accept well-known credit cards, wire transfers, and verified checks. Payment processing is safeguarded with encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- 72 hours or more before departure: Full refund minus service fees
- From 24 to 72 hours before departure: Refund of 50%
- Within 24 hours to departure: No refund available
5.2 Weather Cancellations
Should our captain deem that weather conditions are too dangerous, we will propose to:
- Schedule your charter for another available time with no extra costs
- Issue a full refund if we can't reschedule your appointment
5.3 Mechanical Difficulties
If your designated vessel encounters mechanical setbacks, we will attempt to supply an appropriate substitute. If there is no substitute available, we will provide a comprehensive refund.
6. Safety and Conduct
6.1 Safety Rules
All visitors are expected to:
- Obey all directives given by the crew
- Utilize safety equipment as necessary
- Disclose any medical situations that may influence their safety
- Stay within the designated areas on the vessel
6.2 Banned Items
The following are not permitted onboard:
- Glass bottles
- Controlled substances
- Firearms or any type of weapon
- Immoderate consumables beyond common portions
- Animals (unless pre-arranged)
6.3 Manners
Travelers must act with decorum. We have the right to end a trip prematurely and without issuing a refund if a guest's actions pose a threat to safety or spoil the enjoyment for others.
7. Liability and Insurance
7.1 Our Responsibility
Our liability is restricted to the expenses paid for your transport. We do not assume responsibility for:
- Injuries sustained through a passenger's own neglect
- Damage or loss of personal items
- Indirect, consequential, or penal damages
- Delays prompted by weather events or other instances out of our command
7.2 Insurance
We retain comprehensive marine insurance that encompasses our fleet and operations. You are accountable for ensuring personal travel and property insurance.
7.3 Risk Acknowledgment
By choosing our charter services, you recognize that maritime activities come with intrinsic hazards and you accept responsibility for your personal safety and welfare.
8. Alterations and Itinerary Adjustments
We reserve the right to alter travel itineraries or schedules due to weather, safe practices, or operational demands. We will strive to provide equivalent alternatives.
9. Force Majeure
We withhold liability for delays, cancelations, or changes brought on by events we cannot influence, which include but are not limited to:
- Drastic weather circumstances
- Calamities
- Laws ordained by the authorities
- Shutdowns of ports
- Vessel malfunctions
10. Confidentiality and Data Safety
Your private data is processed as outlined in our Privacy Policy. Engaging with our facilities implies your approval of data gathering and practices as detailed in our Privacy Policy.
11. Proprietary Rights
The content hosted on our site, such as text, photos, logos, and graphics, is subject to copyright and trademark protections. Reproduction, distribution, or the creation of derivative works is forbidden without our explicit consent.
12. Applicable Law
The governing laws of Spain dictate these Terms. Any arising disputes are to be settled by the courts situated in Alcúdia, Spain.
13. Amendments to Terms
We maintain the right to adjust these Terms as necessary. Updates will be publicized on our site with the corresponding revision date. Continuous use of our services signals agreement to the amended terms.
